Unable to save to Illustrator 8 legacy format

Illustrator 23.0.1 (64-bit)
Windows 7 Pro SP1 x64

File saved as Illustrator 8 cannot be reopened by Illustrator CC 2019 or earlier versions.

Create simple file (can be blank, but this doesn't show the full problem.
Save as Illustrator 8 format.
Attempt to ope.
Error message (see screenshot) is displayed.
Click OK.
File then opens, but has no content.

    Chris, I try it with the latest Illustrator and it can open a file saved in version 8 alright, no error message gets displayed.
    Can you please check and verify if it still happens for you?

    Bug in latest version of Illustrator CC2018
    A file saved as version 8 (eps or ai doesn't matter) can't be reopened in Illustrator CC2018.
    Got this problem since this month (January 2018)
