Text on path gets selected when you marquee over empty space
When I need to select something under the arc, like it’s shown in the GIF attached, I can use marquee and the the type object gets selected.
Why?
Did I click the path? No.
Did I click the text? No.
That’s just the 'Illustrator’s way'. Can you make an option to disable this nonsense?

in the moment you touch the bounding box of that path the object gets selected.

Whenever I am working on an artboard for brand identity, I have a lot of text paths on objects. Whenever I try to click and drag over an element, it ALSO grabs the path of the text, which I do not want. Is there a way to only click and drag over the elements you want to touch without having to lock the text paths?
